1. About These Terms

1.1. Gibrid provides you with access to the Service under these Terms.

1.2. By using the Service through any channel — the website, the apps or the Telegram bot — you confirm full and unconditional acceptance of these Terms.

1.3. These Terms are a legally binding document.

2. Service Description

2.1. The Service provides access to artificial intelligence: conversations with AI characters (Souls), creation and configuration of AI agents, image and media generation, and automation tools based on language models. It is available on gibrid.ai, in our applications and through the Telegram bot @gibridaibot.

2.2. We may change the list of features without prior notice.

3. Rules of Use

3.1. You agree to use the Service for its intended purpose and in compliance with applicable law.

3.2. You may not:

• Gain unauthorized access to information in the Service
• Distribute malware, spam, or other illegal content
• Interfere with the operation of the Service or modify its code
• Generate content that violates third-party rights or Telegram's rules
• Use the Service for fraud, disinformation, or harm

3.3. We may restrict or terminate your access for violations of these Terms.

4. Liability

4.1. Gibrid is not liable for damages resulting from use of the Service, including errors, interruptions, or data loss.

4.2. You bear full responsibility for your actions and their consequences.

4.3. Gibrid is not responsible for the content of your requests.

4.4. AI-generated responses are informational and do not constitute professional advice (legal, medical, financial, etc.).

5. Personal Data

5.1. Gibrid maintains the confidentiality of your personal data.

5.2. Details are in the Privacy Policy at gibrid.ai/privacy.

6. Payment & Subscription

6.1. Some features are available on a paid basis. Current pricing is at gibrid.ai.

6.2. Payment is made via the method you select.

6.3. Refunds are governed by the Refund Policy.

6.4. In-app subscriptions on iOS are purchased via the Apple App Store; payment is charged to your Apple ID upon purchase confirmation.

6.5. Auto-renewal. The subscription renews automatically for the same period unless auto-renew is turned off at least 24 hours before the end of the current period. Renewal is charged within 24 hours before the period ends at the stated price.

6.6. Managing & cancelling. You can turn off auto-renewal and manage your subscription in your Apple ID settings (App Store → Subscriptions) at any time. Any unused portion of a trial (if offered) is forfeited upon purchase.

7. Amendments

7.1. These Terms take effect when you accept them and are valid indefinitely.

7.2. We may amend these Terms. Changes are announced on the website and in the Telegram bot. Continued use of the Service constitutes acceptance of changes.

8. Dispute Resolution

8.1. Disputes are resolved through pre-trial proceedings via the support contacts below.

8.2. If pre-trial resolution fails, the dispute is resolved as set out in Section 14.

9. AI Outputs — No Reliance

9.1. The Service uses artificial intelligence. Outputs may be inaccurate, incomplete, or offensive and may not reflect real events. They are informational only and are not professional (legal, medical, financial, or other) advice.

9.2. You are solely responsible for evaluating and verifying outputs before relying on them and for your use of them, including compliance with law and third-party rights.

10. Disclaimer of Warranties

10.1. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant the Service will be uninterrupted, secure, or error-free.

11. Limitation of Liability

11.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, GIBRID AI, CORP. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS.

11.2. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT, OR (b) USD 100. Some jurisdictions do not allow certain limitations, so parts may not apply to you.

12. Indemnification

12.1. You agree to indemnify, defend, and hold harmless Gibrid AI, Corp. from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms, any law, or any third-party right.

13. Intellectual Property

13.1. The platform, software, design, and trademarks are owned by Gibrid AI, Corp. You retain rights to content you submit ("Input"). Subject to these Terms and payment, we assign to you our rights, if any, in content generated for you ("Output"); Output may be subject to the underlying model providers' terms.

13.2. Product and model names are trademarks of their respective owners. Gibrid AI, Corp. is independent and not affiliated with, endorsed, or sponsored by them.

13.3. Copyright complaints (DMCA): [email protected] with the information required under 17 U.S.C. §512(c)(3).

13.4. How to send notices and counter-notices is described at gibrid.ai/dmca. Accounts of repeat infringers are terminated.

14. Governing Law & Dispute Resolution

14.1. These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules.

14.2. Informal resolution first. Before filing a claim, contact [email protected] and attempt to resolve the dispute informally for at least 30 days.

14.3. Binding arbitration. Any dispute not resolved informally shall be settled by binding arbitration on an individual basis. YOU AND GIBRID AI, CORP. WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. Where not permitted by law, the courts in Delaware have exclusive jurisdiction.

15. Age

15.1. You may use the Service from age 13, or from age 16 in the European Union and EEA. By using the Service you confirm that you have reached this age. If you are under 18, use the Service with the knowledge of your parent or legal guardian.

15.2. Creating personas, training models (LoRA) and cloning voices are available only to users aged 18 or older — this is confirmed before first use of the feature.

15.3. If we learn that an account is used by someone under the minimum age, we will delete the account and its data.

16. Faces, Voices & Likeness

16.1. You may create personas, models (LoRA) and voice clones only from your own photos and voice, with the explicit consent of the person depicted, or from AI-generated faces that do not depict real people.

16.2. Prohibited: using someone’s face or voice without consent; images of minors; intimate, defamatory or misleading depictions of real people; impersonation; fraud.

16.3. “AI Legends” are AI recreations based on public sources. The real people are not affiliated with Gibrid and have not endorsed them. You may not present their replies as statements of real people or use them in advertising.

16.4. A person whose face or voice was used without consent may request removal: [email protected].

17. AI-Generated Content

17.1. Images, video, audio and text are generated by AI. When you publish them, you comply with AI-content labeling requirements (including the EU AI Act) and do not present them as real events or words of real people.

18. Outreach & Agents Talking to People

18.1. You are responsible for the lawfulness of your outreach: a basis to contact recipients, compliance with Telegram and WhatsApp rules and advertising laws.

18.2. A recipient’s request to stop (“stop”, “unsubscribe”, “don’t message me”) is honored automatically: the recipient is added to your stop list and messages to them stop.

18.3. Agents do not pretend to be human: when asked directly, they say they are AI.

18.4. We may suspend outreach and accounts that break these rules.

19. Miscellaneous

19.1. In all other matters, applicable law governs.

19.2. Invalidity of any provision does not affect the remaining provisions.
